AIBU?

Hit by a Lorry (warning cyclist thread)

I am so pissed off at the moment. So much I have to ask myself if IWBU. On Tuesday I was hit by a lorry whilst riding my bike. The bike is a mess, I was lucky to get away with bruises. Won't go into details as the police are involved, suffice to say the witnesses have said undue care and attention is a possibility. She has told the insurers she doesn't accept full liability which means a whole raft of additional hoops to jump through . Then googling I discover this young girl only passed her HGV less than 2 weeks ago.
I was so angry about her not admitting liability I have posted on that FB page - the company congratulating her on her success (easy way of achieving test through minimum training) that it is a shame she doesn't know how roundabouts work. WIBU by posting on that site?

To be honest I am more taken back by her audacity of saying not liable than the accident itself! It was a near miss and extremely lucky I didn't actually end up under the lorry myself and only have the bruises I have.

I can understand you being angry enough to post on the fb page.

Were you on the roundabout and she pulled out?

Yes

Can't really say without knowing what actually happened. But no you shouldn't post that on the site. She passed he test a few weeks ago, we all have to start somewhere.

Dont post anything if it could have an impact on the claim / police investigation. Wait until that is resolved.

Glad you walked away with bruises and hope she has learnt a very valuable lesson.

Glad to hear that you are ok...
Dont post anything on their facebook page while the case and insurance claim are still ongoing...it wont make you look good

I'm sure it was not a 'young girl' driving a lorry.

I'm sorry for what happened to you op but I think you need to leave it up to the police ad insurers, posting on their fb page will solve nothing.

I completely understand that your angry - and rightly so! But I'd delete that Facebook comment before you aggravate the situation

Can see why you're angry but I think you should take that post down. It's defamatory potentially apart from anything else.

If it's an ongoing investigation then you were extremely unwise to post anything. I would delete asap but if they've screen shotted it you might be in trouble.

There was something on the TV the other night about lorrys having blind spots.

Insurers usually demand that their clients don't admit liability after an accident, even where the fault is obvious.

Apparently you only have to be 18 to have an HGV licence and can get one with 10 days training. She didn't look more than that . Ok young driver if you prefer.

That's awful and I would be raging too. But posting on the FB page isn't a great idea while investigations are on going.
If you were on the roundabout and she pulled out on it then surely it's a no brainer??
We have some haulage companies round here that are notoriously bad with cyclists so much so that a lot of people wear cameras.

Who was on the roundabout first?

Didn't realise you can get a Hgv licence at 18yo.

I do think that's too young. You need more general driving experience IMO before being behind the wheel of a Hgv.

You shouldn't have posted on their page.

Insurance companies tell you not to admit liability. If she was at fault then she will be found to be.

Glad you are ok.

Umbongo we all have to start somewhere....yes but preferably we would start by not potentially killing a cyclist. I'll learning to drive and I hope that is my attitude when I pass. Oh I can take out a few cyclists as I have to start somewhere.Hmm

Don't post, screen shot and give it to a solicitor.

I did wonder if I was being a bit hasty! I thought you had to be 21 to get an HGV licence , maybe it was reduced? Maybe I was under the wrong impression .

Yes preferably. But sometimes mistakes happen. I've been driving for years and this morning I nearly hit a runner. Technically it was his fault but because I was driving it would've been me who got in trouble.

That said OP it's pretty difficult for anyone on a forum to comment on an accident we didn't see. It's hard to be subjective about an accident as the victim or the accused. Only neutral witnesses tend to be subjective.

Report
2beesornot2beesthatisthehoney · 18/08/2016 09:06

Both witnesses were neutral but I wasn't asking you to comment on the accident- how could you? Only the FB post

Also I wouldn't be worried about their FB page. It might prompt the company into supervising the young lady a bit longer whilst she gains road experience with a second driver. They have full control over their page and can delete your messages so it's not a problem to the company.

Glad you're OK bar a battered bike and bruises.

As a previous poster said, you are told not to admit liability soYABU to be annoyed at that. You shouldn't have posted on the website either - were you stalking her on social media to find it??

Leave it to the police and insurance companies and concentrate on yourself.
