AIBU or is ebay seller about delivery timeframe

I bought a TV on eBay on the 4th and paid promptly. The listing said the seller would dispatch within 2 days of cleared payment and they marked the item as dispatched so I've been looking out for it and have tried to make sure either DH or I are in most of the time to receive it. We're self employed so haven't missed work but have had to do some juggling.

This morning the seller messaged me to say
"Hi there. Thanks for buying tv, will be posted out on 13th as im currently out of the country visiting family."

This delay was not mentioned in the listing or I wouldn't have bid as I needed it sooner. Because they didn't mention the delay in the listing I've wasted time and money on an item that won't be delivered in the time frame I require. Because they marked the item as dispatched when it isn't and they had no intention of dispatching it till the 13th, I've been waiting for it, which has caused me inconvenience. They seem to think it's no big deal but I'm annoyed. I've asked for a refund. AIBU?

Report them to ebay.

Show them a screen shot of 'posted '

Although is it possible to need a TV?

Well we actually need very little to live. Food, oxygen, some kind of shelter... What I meant was I required it within the stated timeframe and would not have bid if I'd been warned about the delay.

What happens if I report them to eBay though? Should I go with item not received or not as described because the delivery timeframe mentioned in the ad was inaccurate? Is it OK to report not received after only 4 days? I think they will put a hold on the money and I don't know how long it will take for them to come to a decision. I was hoping the seller would just decide to do the right thing and refund because that might be quicker but I'm concerned about their casual attitude to the issue.

If the seller doesn't give you a refund quickly, open a case on eBay.

I own a small business that sells on eBay...if I make a mistake and upset a buyer, I put it right quickly.

I'm assuming your seller is not a professional seller, just someone selling their old TV, hence the lack of customer service intelligence - tw*t!

Yes they're not a professional. Neither am I though but when I've sold old stuff on eBay I've still seen it as a business agreement and delivered quickly. They had good feedback but I've just realised it's all as a buyer so they might not realise what is required of a seller. Still I don't think they would be happy if they bought an item and there was such a delay in delivery!

I'm actually not sure if you can open a case so soon, thankfully it's not something I've ever had to do myself or deal with as a seller.

YANBU, when placing a listing the seller has to select an option for how long it will take them to dispatch the item. This combined with the delivery service they offer produces the estimated delivery date.

If they are funny about giving you a refund then as soon as the latest delivery estimate passes, open an item not recieved dispute to claim a refund then leave appropriate feedback, after the dispute had been settled. Make sure you keep it factual.

As a buyer I've often been gobsmacked about a seller's attitude - both casual and professional sellers.

"I was on holiday and my mum didn't get round to posting it" was a bit of a classic for me.

Why list when you're going to be away when the auction ends?!

OMG he has just got back to me saying:

"I can see if a friend will post for me however as you will see it's clearly stated refunds and returns will not be accepted "

It also clearly states he will dispatch 2 days after receiving payment! Am I correct to think the bit about no refunds doesn't count if he lied?! I am fuming!

Just checked the listing and it says no returns not no refunds so reminded him of that. I think the worst thing is that he has not apologised or acknowledged the inconvenience.

Make sure you leave honest feedback.
"TV was ok, but it wasn't sent until a week after the promised date, despite being shown as posted"

TBH I don't want it now. I want a refund so I can buy something that would be delivered on time. I don't trust the seller at all and I'm worried that now I've been difficult about it the item might be delivered in less than satisfactory condition shall we say.

If you make a formal return request with eBay then the Seller will pretty much have to agree - never mind what the listing says.

If a Seller doesn't give in to a customer's demands (totally justified in your case) then it goes against their performance level. If your performance level drops enough Sellers receive penalties - such as being allowed to list fewer items per month. As a Seller, it's rarely worth refusing a return. Especially in your circumstances where eBay would find in your favour anyway!

I think the only way you will get out of buying the TV is to raise a report with Ebay, particularly if he said no refunds. I have had to raise issues with ebay before and they have been resolved quickly, i'm sure this would be too. Quite often what ends up happening is Ebay (or Paypal) give you the money back and then they chase for it from the seller.

if you have already messaged him and said that you bid on the basis of the dispatch time, I would then tell him you are opening a case with ebay, and just do it. I'm pretty sure ebay will find in your favour, it may take a little while for the money to come back though.

Thanks for the advice guys. I have screenshotted and will open a case. It's just a shame that this is necessary. I wouldn't treat someone this way.

I thought eBay always sided with the buyer. Report it to eBay, you will get your money back no problem, although it might take a little while.

I hate eBay with a passion!

You can open an item not received dispute the day after the estimated delivery date. The bit about no refunds and no returns is meaningless if it either doesn't arrive or isn't as described. After (I think) about 8 days you can escalate the dispute and unless the seller can provide tracking to prove the television has been delivered, ebay will refund you.
It would be worth contacting ebay customer services (I think unless you are a business seller this is now by email or live chat only). Sometimes they will refund you without having to go through a dispute, when the seller is so clearly out of order.
