To be pissed off at having just seen my tenants spending a load of cash whilst they're behind on rent?

I am fed up to the back teeth.

This is the third month now where they're falling behind.

(I know them by their appearance and we have a mutual friend on a social networking site)

I have just seen them paying for a spa and no doubt it'll be up on social media next week (they like to brag and display all their newly acquired gains in Instagrammed glory.)

Next month my kids won't have the birthday parties they wanted because I'm subsidising these idiots living expenses and incurring charges as for their late/part payments. Angry

Has anyone managed to get tenants out despite then not being 2 months late on rent. The Lettings agency have told me I'm stuck with them . Can I fine them?

They got a 12 fixed contract in January and surprise-surprise they started to default from day one of it.

I'm so upset.

Doreen I cannot do that as they aren't a full two months behind
I can only serve them when they default by the x2 lots of monthly rent

They pay 30% ten days late then another 20% a week later

Do they actually owe you two months' rent or have they just paid late for the last two payments? Because that would affect how you would approach it.

As for your kids' birthdays, I'm not sure you're in the right business if a couple of late payments means that you cannot fund your own lifestyle. What would you do if you had a void period for a couple of months? Or needed to put a new boiler in? It happens and you need to budget for that. If you haven't, you're doing it wrong. It's partly because of concerns like this that amateur small-scale landlords are a bad idea - there are always going to be expenses and late payments and all the rest of it and people who have no way of covering that are not fit to be in the really rather important business of providing shelter.

It sounds like they know exactly what they're doing and have effectively revised their rent downwards themselves. That's not the op's fault and it's not fair to criticise her.

Cruikshank- very patronising but FYI the last time this happened a few years ago it took me 6 months to get non payers out then they trashed the place. £5000 it cost me.

Because I don't live like these twats - I'm thinking and being cautious

I have insurances in place for repairs to essentials and I've put in a new boiler as the last tenants trashes the house. You're advice isn't helpful cruik

Like I said, it sounds like you're in the wrong business. They aren't doing this as a personal attack on you, and neither did the tenants who trashed the place. If you're so invested in them that you're looking them up on instagram and wringing your hands about children's parties, I really don't think this is the job for you.

Do they claim HB?

My tenant struggled for 3 months and I got in touch with the HB people who now pay me direct.

Ahh youre not the poster who posted a few months back about having to get skips to empty the house of previous tenants' stuff and replace floor boards and walls etc?

I recall on a recent thread about similar that you can have some legal notice of something sent to them to scare them into straightening up. Post in legal for real advice. AIBU not the place.

Also, you really should be able to cover a few months rent from ringfenced savings if you are a landlord. Otherwise dont be a landlord. Especially dont be a martyr landlord with your poor wee dcs not eating Hmm

Cruel, you don't actually know whether the op has reserves for stuff like the boiler or whatnot that she refuses to spend on birthday parties.

You're actually talking nonsense. OF COURSE the op is going to be hacked off her rent isn't being paid whilst she can see on social media that they spending their money on other things.

It's nothing to do with them having a personal dig at her. At all. I don't believe the op thinks that. She just wants her rent.

Op, can you give them notice? Just get rid. And keep their deposit.

I won't be spending unnecessarily because chances are these fuckers know exactly what they are doing and that I cannot serve them until they are 8 weeks in arrears.

If you have a safety net why isnt that covering the shortfall? From what i can tell they arent two months in arrears but are just late in paying?

Check your tenancy agreement. Sometimes you can serve notice for just being late. Is it managed by an agent? If not, it might be a good idea to start doing that so the agent can wade in and give them a harder time of it than you could. if the tenants don't pay then that's less of a percentage for the agency.

I really feel for you OP. No really advice but unfortunately you will just have to follow the law. Give them their marching orders with great satisfaction on the first possible day you can.

Yes managed by an agent
They've not paid the FULL amount so by the end of the month they've payed part of the £900 - part payment which then rolls onto the next month
