to think i am being ripped off?? gumtree / paypal related

I sold a Louis Vuitton scarf on gumtree recently

the lady paid via pay pal about a week ago and I posted it out recorded etc

she emailed me today claiming its fake (I KNOW isn't, but as I bought it years ago I have no proof of purchase or anything like that, and she knew this when she bought it)

but she says she wants her money back and will report me to paypal and gumtree

I am worried paypal will automatically take her side and just assume it is fake as i can't prove it isnt. then I will have to refund and I wont get my scarf back as I think so she will keep my scarf AND my money. as i am sure i have heard that paypal just tell the buyers to destroy the item in this instance.

does anyone have any suggestions? :(

Can you start a dispute on paypal about this? And insist it is coming back to you?

Just tell her to send the scarf back and you will refund when you receive it - including return postage.

Then if she raises a case with paypal you can demonstrate that you were being entirely reasonable about it. I don't know if it will make a difference, but it certainly should.

She sounds like a chancer that wants the money and the scarf.

This doesn't help you now but NEVER accept Paypal for a Gumtree sale. I always insist on cash on collection as unfortunately, as you are finding out, Paypal tend to side with the buyer. And there are a lot of clever scams out there involving Paypal and couriers.

I don't know if this particular lady is just trying it on, genuinely thinks it's fake, or is scamming you purposely. I hope someone can suggest something for you

I don't know what you can do to prove its real and don't know what stance PayPal would take. I'd get her to post it back so you get your scarf back and can sell it again so it won't leave you too short.

I would be worried that if she returns the scarf that it's her fake version of your genuine one that you sent her that you get back.

I would be very careful to check the scarf over entirely IF you get it returned. Scammers will sometimes return cheap imitations so they receive a refund and can sell on the original genuine item you sold them.

Do not refund until you recieve the item back.
Be aware though paypal side with buyers.
I sold a games console UK Seller only as wanted to send recorded.
Someone bought it in Spain. After a bit of a conversation i agreed to send. I got proof of postage.
He claimed he hadnt recieved it. I disputed with proof of postage. Paypal still paid him.

Also check the scarf you get back is the one you sent.

Get in there first with Paypal so you look proactive about finding a resolution. I also think you should mention in the dispute you raise with paypal that the buyer knew you didn't have proof of purchase so she took the risk willingly.

Defintely get in there first, as others have said, PP tends to take buyers sides (I never use paypal or ebay anymore, I've had so many rip off buyers who take advantage of paypal always siding with them) I hope you get it back! Has she said any reason why she thinks it's fake?

The only thing that realistically will work is if you ask PayPal to commence their fakes procedure, which means the buyer would need to get proof on headed paper that LV have declared the scarf fake. If the buyer does have a fake scarf, this won't help you, as she'll likely take that.

If buyer gets proof, PayPal will refund them and either chase you for the money or take it out of your PayPal balance. They will be told to either keep or destroy the scarf but it is not legal to send fakes so PayPal will not ask them to return it to you.

If the buyer can't get proof, PayPal should allow the case to time out.

PayPal for Gumtree is dodgy for this reason, you needed cash on collection so that the buyer had no recourse down the line.

Surely even if she has a fake scarf, the chances of it being exactly the same size, pattern, colour and condition as your one are slim?
