To put this on Freecycle?

Back in early July DH and I ordered a fancy new fridge-freezer from John Lewis. We were v excited as it was all bells and whistles, ice-maker etc. They told us delivery would take 2-3 weeks so we paid up and waited.

Weeks passed and we heard nothing, so DH rang them and said, 'We have no fridge, any chance the new one will be delivered any time soon?' After several chasing phone calls and promises that they'd call us back (which never happened) and finally an e-mail to customer services, they eventually responded, 'oh sorry, that's a new model- you shouldn't have been told 2-3 weeks, it's not even in stock with the supplier yet. It will be another 6 weeks or so. But don't worry, we will loan you a fridge until then'.

So about a week later they delivered a brand new Zanussi fridge-freezer (a bog standard one, not a fancy American style one, but still - brand new). We were very grateful. They told us that this loan fridge would be collected when our new one was delivered.

Eventually in early September we received delivery of our new fabulous fridge-freezer. However, the delivery men wouldn't take the loan fridge from us (typical) and said John Lewis would be in touch to arrange collection. Guess what? We heard nothing. DH called them 3 times and got nowhere ('someone will call you back' - yeah, right) before giving up. Weeks passed. DH threatened to put it on ebay. I stopped him, saying 'It's not ours to sell'.

Last week DH called John Lewis YET AGAIN to say, 'look, do you want this bloody thing back or not?' and they said they would collect it on Monday this week between 1pm and 7pm. You guessed it! Nobody turned up. We've heard nothing from them since.

AIBU to put it on Freecycle and give it to someone who needs it? I don't have room to store it and have no use for it. John Lewis do not appear interested in having it back. BUT - it's not ours to give away, is it?

AIBU???

I would put it in writing stating that if you have not heard from them within X days then you will be giving it away.

YANBU, if they come back to you about it, tell them you have charged them for storage, and taken the firdge as payment

Wow, I'm surprised at John Lewis. I would write to their head office explain all the inconvenience and as Rosa said that if you've not heard from them in X days you will give it away. I would also meake sure that you send the letter recorded so that you know that they have received it.

I would write as Rosa suggested, it isn't yours and legally I think they could ask for it back.

Have you got a local John Lewis store you can pop into, speak to the Manager and ask for it to be collected. Perhaps talking to somebody in person would help.

Yes there's a local John Lewis - I'm just bored of chasing them and it's a pain to go there with a 6 month old esp as parking is £1 per 15 minutes!!! Shock

I'm really surprised at how crap they've been too. I would think they would have a problem claiming it back from a legal perspective (I am a solicitor but this isn't my area) as they have failed to collect it and been chased, but think it is sensible to put it in writing to them.

I'm on the Wirral Rebeccash if that's any good to you!

Put it in writing to cover your back.

If you need to go into your local branch, keep the parking ticket and claim for it.

Could you freecyle a loan of the fridge - and explain they might have to let john lewis collect it one day - but it gets used in the meantime?

Ah bless you, I am in Nottingham so not exactly local but I really think you should put it on freecycle so some-one can benefit from it
